Birmingham Responder Suing City, Mayor for Failure to Pay OT

BIRMINGHAM, AL – A Birmingham firefighter is suing the city and Mayor William Bell claiming the city failed to pay overtime.
The lawsuit claims firefighters were not paid time-and-a-half for extra hours worked. It also claims by not paying time-and-a-half on those extra hours, the city no longer matched all pension benefits as required.
Local firefighter union attorney Ray Fitzpatrick said Tuesday the bigger issue is making sure the city does not cut firefighter pay.
In order to cut anyone’s pay, it takes city council action, and we hope and continue to work to make sure the city council will not cut our pay," Fitzpatrick said.
Mayor Bell on Tuesday refused to comment on the issue, saying the city’s legal staff would work to handle the matter.
